Me, Remembered AI (the "Service") is operated by Guardian Inc. ("we", "us"). When you use the Service you are contracting with Guardian Inc.. By creating an account or continuing to use the Service, you agree to these Terms.

1. The Service

The Service lets you record memories, photos and audio, and uses artificial intelligence to create a conversational "digital twin" that loved ones you choose can talk to. Paid plans add features such as voice replies, Twin Parties, talking-avatar videos and voice cloning.

2. Eligibility and your account

You must be of legal age in your country to use the Service, and if you use it on behalf of an organization you must have authority to bind it. Keep your login details confidential; you are responsible for activity under your account. Provide accurate information and keep it up to date.

3. Acceptable use

You must not misuse the Service. In particular you must not:

• use it for anything unlawful, fraudulent, or to send spam;
• infringe anyone's intellectual property or privacy rights;
• upload malware, probe or attack our systems, scrape the Service, or bypass technical limits;
• create a twin, voice clone or avatar of another person without their permission, or create deepfakes intended to deceive;
• use the AI to produce hateful, harassing, sexual, violent or illegal content, or attempt to "jailbreak" its safety rules;
• reverse engineer, resell or redistribute the Service.

4. Your content and AI output

You keep ownership of the memories, photos, recordings and other content you upload, and you confirm you have the right to upload it. You grant us a limited license to host and process that content solely to provide the Service to you and the people you share with. You are responsible for what you ask the AI and how you use its replies.

AI replies are generated automatically and may be inaccurate or not reflect what the real person would say. They are not medical, legal, financial or other professional advice.

We may remove or restrict content, filter AI output, or suspend accounts that break these Terms. If you believe content on the Service infringes your rights, email alayna.rodriguez@advancedfutureai.onmicrosoft.com; repeated infringement leads to account termination.

5. Our intellectual property

We retain all rights in the Service, including its software, design, documentation and branding. We grant you a limited, non-exclusive, non-transferable right to use the Service within your plan.

6. Payments and subscriptions

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Payment, billing, renewal, taxes, cancellation and refunds are governed by Paddle's Buyer Terms. Subscriptions renew monthly until cancelled. Purchased avatar minutes do not expire. See also our Refund Policy.

7. Service availability

We work to keep the Service running, but we do not guarantee it will be uninterrupted or error-free. The Service is provided "as is" and, to the fullest extent permitted by law, we disclaim implied warranties of merchantability and fitness for a particular purpose.

8. Suspension and termination

We may suspend or end your access for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. You may close your account at any time. When your account ends, your content is deleted within a reasonable period unless the law requires us to keep it.

9. Liability

To the extent permitted by law, we are not liable for indirect or consequential losses (such as lost profits or data), and our total liability is limited to the fees you paid in the 12 months before the claim. Nothing limits liability for fraud, death or personal injury where the law does not allow it. You agree to indemnify us against claims arising from your content or your breach of these Terms.

10. General

We are not responsible for delays caused by events beyond our reasonable control. You may not transfer your account without our consent. We may update these Terms and will post the new version here. These Terms are governed by the laws of the State of California, USA.
